Information on the right to withdraw from a distance contract under Sections 19 and 20 of Act No. 108/2024 Coll. on consumer protection

In brief

  • You have 14 days from receiving the goods to withdraw from the contract, without giving a reason.
  • If the size does not fit, we will gladly exchange the piece within 14 days of receipt, provided it is unused (section 7).
  • An e-mail to info@theliberty.store is enough, the form below is optional.
  • We refund your money within 14 days of receiving the withdrawal, by the same method you paid with.
  • The cost of sending the goods back is borne by the buyer.

1. Right to withdraw from the contract

As a consumer you have the right to withdraw from the purchase contract without giving a reason within 14 days.

The withdrawal period expires 14 days from the day on which you, or a third party designated by you other than the carrier, take receipt of the goods. If the goods are delivered in parts, or consist of several items delivered separately, the period runs from receipt of the last item.

The deadline is met if you send the notice of withdrawal no later than the last day of the period.

You can withdraw from the purchase of a gift card within 14 days of the contract being concluded, that is, of the order confirmation being delivered. We will refund the amount paid by the same method you paid with and cancel the card.

2. How to withdraw

You may use the model form below, but you are not obliged to. We will confirm receipt of your withdrawal by e-mail without delay.

3. Returning the goods

Send or hand over the goods to us no later than 14 days from the day you exercised the right of withdrawal, to Adam Oláh TLBRTY, Bernolákova 800/33, 952 01 Vráble.

  • The direct cost of returning the goods is borne by the buyer.
  • Send the goods complete, including accessories and proof of purchase; we recommend the original packaging and registered, insured delivery. We do not accept cash-on-delivery parcels.
  • The goods must not be returned damaged beyond what normal testing involves.
  • If you received a gift with your order, return it together with the goods. The same applies if you return only part of the order and its value thereby falls below 99 €. If you do not return the gift, or return it damaged beyond what normal testing involves, we will set off its value of 19 € against the refund.

4. Refund of payment

After withdrawal we will refund all payments you made in connection with the contract, including the cost of delivering the goods to you (except any additional cost if you chose a delivery method other than the cheapest standard one we offer).

We will refund without undue delay and no later than 14 days from the day the notice of withdrawal reaches us, by the same method you used to pay, unless you have expressly agreed otherwise; you will incur no further charges as a result.

Payment for the goods will be refunded once the returned goods reach our address, or once you provide proof that you have sent them back, whichever comes first.

5. Liability for a reduction in the value of the goods

You may try the goods as you would in a physical shop, that is, check their properties and how they work. You are, however, liable for any reduction in the value of the goods caused by handling beyond that (for example a scratched or deformed piece, removed tags, or wearing the piece). In that case we are entitled to claim compensation for the reduction in value and to set it off against the refund.

6. When the right of withdrawal does not apply

Under Section 19 (1) of Act No. 108/2024 Coll., the right of withdrawal does not apply in particular to:

  • goods sealed in protective packaging that are not suitable for return for reasons of health protection or hygiene once that packaging has been opened, typically earrings and piercing jewellery.

We also point this out for the specific products in the shop before the order is completed.

A bracelet or necklace you assemble in the shop's workshop can be returned like any other goods.

7. Exchange

Beyond our statutory obligations we are happy to offer an exchange for a different size or model if you contact us within 14 days of receipt and the goods are unused. Write to info@theliberty.store and we will arrange the details.
