2. Introductory provisions
These terms and conditions govern the rights and obligations of the parties to purchase contracts concluded at a distance through The Liberty online shop (the „shop“) between the seller and the buyer.
The legal relationship is governed above all by Act No. 108/2024 Coll. on consumer protection, Act No. 40/1964 Coll. the Civil Code, Act No. 22/2004 Coll. on electronic commerce, and Act No. 94/2013 Coll. on hallmarking and the assaying of precious metals (the Hallmarking Act).
A consumer is a natural person who, when concluding the contract, is not acting in the course of their business. If the buyer purchases in the course of business (and gives a company ID), the provisions on consumer rights do not apply to them and the relationship is governed by the Commercial Code.
3. Orders and conclusion of the contract
- The buyer adds the chosen goods to the cart, fills in delivery and billing details, and selects a shipping and payment method.
- Before sending the order the buyer can check and change every entry, including quantity, size and delivery address; corrections can be made by going back a step.
- The buyer sends the order by pressing the button marked „Order with an obligation to pay“. By sending the order the buyer confirms having read these terms and the information on the right of withdrawal.
- The seller confirms receipt of the order by e-mail without delay. The purchase contract is concluded when the order confirmation is delivered to the buyer's e-mail address.
- The contract is concluded in Slovak, Czech or English, depending on the language in which the buyer sends the order. The seller archives it electronically.
- Stones, beads, metal parts and gift packaging are sold only as part of a piece the buyer assembles in the shop's workshop. An order for parts alone, without a piece, will not be fulfilled: if such an order is accepted, the seller will withdraw from the contract and refund the amount paid without undue delay, and no later than 14 days.
4. Prices and payment
Prices shown with individual products are final and do not include delivery costs, which are shown separately in the cart before the order is sent. The total payable is shown to the buyer before the order is confirmed.
Prices are shown and charged in euros (EUR). If the buyer pays with a card in another currency, Czech koruna for example, the buyer's bank converts the amount at its own rate.
The buyer pays by card online through a secure payment gateway (including Apple Pay and Google Pay where available), payment is taken immediately with the order.
The seller has no access to card details; those are processed solely by the payment gateway provider. For every order the seller issues proof of purchase and sends it electronically to the buyer's e-mail.
4.1 Gift with your order
Where the value of the goods in an order reaches 99 € (before any discount code is applied, excluding the delivery charge), the seller adds a cord bracelet to the order as a free gift. The buyer chooses its colour and size in the cart before sending the order.
- At most one gift is given per order.
- The gift is given while the chosen colour and size are in stock.
- If a discount code cannot be combined with the gift, no gift is given with the order.
- The gift cannot be exchanged for money or for other goods.
- The gift is an ancillary contract to the purchase contract. If the buyer withdraws from the purchase contract, or returns part of the goods so that the value of the order falls below 99 €, the gift is returned together with the goods. If the buyer does not return it, or returns it damaged beyond what normal testing involves, the seller is entitled to set off its value of 19 € against the refund.
- The seller may change or end the gift offer at any time; for an order already sent, the offer in force when it was sent applies.
4.2 Gift card
The gift card is an electronic voucher worth 30, 50, 100 or 200 € for buying goods in The Liberty online shop.
- We e-mail the gift card code to the buyer without undue delay once the order has been paid. If the buyer names a recipient, we send it to the recipient's e-mail address on the day the buyer chooses. The buyer is responsible for that address being correct.
- You redeem the card at checkout by entering the code in the discount code or gift card field. The value is deducted from the order price and any unused balance stays on the card for further purchases. If the order price is higher than the balance, you pay the difference by another payment method.
- The gift card is valid for 12 months from the day of purchase. The expiry date is shown on the card page. After that date any unused balance lapses.
- The gift card cannot be exchanged for money, except on withdrawal from the contract as described in the information on withdrawal. A gift card cannot be used to pay for another gift card.
- The price of a purchased gift card does not count towards the order value for the gift with your order (section 4.1) or for free delivery (section 5).
- If you return goods paid for with a gift card, the amount paid by card is refunded to the same card.
- Keep your gift card code safe. Anyone who knows it can use it.
5. Delivery
The seller delivers to Slovakia and the Czech Republic through Packeta Slovakia s. r. o. (Zásielkovňa) to pick-up points and Z-BOXes, or to the buyer's address. In the Czech Republic parcels are delivered by the Zásilkovna network of the Packeta group.
- Dispatch: goods are dispatched within 5 working days of the contract being concluded.
- Delivery: usually 1 – 3 working days from dispatch within Slovakia and 2 – 4 working days to the Czech Republic.
- Shipping cost (the same for Slovakia and the Czech Republic): pick-up point or Z-BOX 2.99 €, courier delivery to your address 3.99 €. Orders from 79 € (value of the goods after discounts, excluding delivery) ship free with either delivery method.
- The gift card is delivered electronically by e-mail; no delivery charge applies to it.
- If the goods cannot be dispatched within that period, the seller will inform the buyer without delay and either agree a new date or refund the amount paid.
The risk of accidental loss of or damage to the goods passes to the buyer when the goods are received. We recommend checking that the parcel is intact on receipt; obvious damage to the packaging should be reported directly to the carrier and to the seller.
6. Materials and their properties
In the shop a customer can assemble a piece from individual components or buy a finished one. The jewellery combines several materials, above all semi-precious stones and minerals, components of 925/1000 fineness silver, and where applicable surgical steel or other metallic and non-metallic materials.
The exact composition of every product is stated in its description in the shop. For assembled pieces the composition matches the components the customer chose.
6.1 Components made of precious metals
Where a product contains silver parts, the silver is of 925/1000 fineness (sterling silver), which exceeds the lowest fineness of silver permitted for trade in the Slovak Republic. Those parts are marked with a fineness number in accordance with Act No. 94/2013 Coll. (the Hallmarking Act).
Jewellery containing at most 3 g of silver per piece counts as goods of very low weight and is not subject to compulsory hallmarking control (Section 13 (1) of Decree No. 119/2013 Coll. as amended by Decree No. 336/2024 Coll., effective from 15 December 2024); the fineness marking applies to it nonetheless.
6.2 Surgical steel and other materials
Components of surgical steel and other non-precious metals are not subject to the Hallmarking Act. Their composition and surface finish are stated in the product description.
6.3 Natural properties of the materials
- Silver is a natural material that oxidises over time (darkens) through humidity, cosmetics, perfume and perspiration. Oxidation is not a defect, it is reversible and can be removed with a silver polishing cloth.
- Semi-precious stones and minerals are natural; variation in colour, pattern, transparency, shape and size is inherent to them and is not treated as a defect. Photographs in the shop are illustrative, the individual stone may differ slightly.
- Handmade production and assembly brings small variations in dimensions and finish, which are a mark of originality rather than a defect.
We recommend taking jewellery off before bathing, sport and sleep, keeping it away from cosmetics and chemicals, and storing it dry and separately from other pieces.
7. Withdrawal from the contract within 14 days
A consumer is entitled to withdraw from a distance contract without giving a reason within 14 days of receiving the goods, in accordance with Sections 19 and 20 of Act No. 108/2024 Coll.
Full information on the right of withdrawal, how to exercise it, refund deadlines, the cost of returning goods and a model withdrawal form are set out on the Withdrawal from contract and returns page, which forms an integral part of these terms.
The right of withdrawal does not apply to goods sealed in protective packaging that are not suitable for return for reasons of health protection or hygiene once that packaging has been opened (earrings, for example). A bracelet or necklace you assemble in the shop's workshop can be returned like any other goods.
8. Liability for defects and the claims procedure
The seller is liable for defects the goods have on receipt, and for defects that appear within 24 months of delivery. If a defect appears within 12 months of delivery, the goods are presumed to have been defective on delivery.
8.1 How to make a claim (reporting a defect)
- Report the defect without undue delay by e-mail to info@theliberty.store or by post to the seller's address.
- In your message give the order number, a description of the defect and your preferred remedy. A photograph helps.
- The seller issues the buyer written confirmation that the defect has been reported, stating the date, the content of the claim and the deadline for remedying the defect.
- Send the goods to the seller's address once the method of delivery has been agreed. The cost of sending goods for a claim is borne by the seller where the claim is justified.
8.2 The buyer's rights where there is a defect
The buyer may first of all choose repair or replacement. The seller may refuse the chosen method if it is impossible or would involve disproportionate cost in the circumstances.
The buyer has the right to a reasonable reduction in price or to withdraw from the contract, in particular where the seller has not remedied the defect within the deadline, has refused to remedy it, where the defect has recurred, or where it is a serious defect. The contract cannot be withdrawn from over a negligible defect.
8.3 Time limit for settling a claim
The seller will remedy the defect within 30 days at the latest from the day it was reported, unless a longer period is agreed with the buyer. If that period is not met, the buyer has the right to a discount or to withdraw from the contract.
8.4 What is not a defect
- natural oxidation of silver and normal wear corresponding to how the piece is used,
- mechanical damage caused by the buyer (deformation, a chain torn by pulling, scratching),
- damage by chemicals, cosmetics, chlorinated or sea water,
- natural variation in the colour, pattern or shape of semi-precious stones and minerals,
- small variations in shade, texture or dimensions typical of handmade production.
9. Alternative dispute resolution (ADR)
If a consumer is not satisfied with the way a claim was settled, or believes the seller has infringed their rights, they have the right to approach the seller with a request for redress at info@theliberty.store. If the seller replies in the negative or does not reply within 30 days, the consumer has the right to submit a proposal to open alternative dispute resolution.
The competent ADR body is the Slovak Trade Inspection, Department for International Relations and Alternative Consumer Dispute Resolution, Bajkalská 21/A, p. p. 29, 827 99 Bratislava 27, e-mail: ars@soi.sk or adr@soi.sk, or another authorised legal entity on the list of ADR bodies kept by the Ministry of Economy of the Slovak Republic. Dispute resolution is free of charge for the consumer.
A consumer living in the Czech Republic can also contact the European Consumer Centre Czech Republic at the Czech Trade Inspection Authority, which helps free of charge with cross-border disputes with traders from other EU countries, evropskyspotrebitel.gov.cz.
Note: the European ODR platform ceased operating on 20 July 2025. The list of ADR bodies within the EU is kept by the European Commission at consumer-redress.ec.europa.eu.
10. Personal data protection
The processing of buyers' personal data is described in detail on the Privacy policy page. The use of cookies is governed by the Cookie policy page.
11. Final provisions
The seller reserves the right to change these terms; for any given order the wording in force when the order was sent is decisive. If any provision is invalid, the remaining provisions stay in force.
Contractual relations not covered by these terms are governed by the law of the Slovak Republic. Where the buyer is a consumer habitually resident in another EU country, the Czech Republic for example, this choice of law does not deprive them of the protection afforded by the provisions of the law of their country of habitual residence that cannot be derogated from by agreement. A consumer may also bring proceedings before the courts of the country where they are domiciled.
These terms and conditions take effect on 18 October 2026.
